These general terms and conditions govern the contractual relationship between the company LES DETECTEURS, a limited liability company, registered under number 918 129 743, whose registered office is located at 84 AV FRANKLIN ROOSEVELT 06110 LE CANNET FRANCE (hereinafter referred to as “LES DETECTEURS”) and any person visiting, making a purchase (hereinafter referred to as “the customer”) via the site accessible at the address www.les-detecteurs.fr (hereinafter referred to as “the Site”). LES DETECTEURS and the Internet user will hereinafter be collectively referred to as “the Parties”.

The Parties agree that their relations will be governed exclusively by these General Conditions of Sale which are accessible on the Site.

These Conditions may be subject to change. Therefore, it is understood that the applicable Conditions are those in force on the Site at the time the Customer’s order is registered.

The date these General Conditions are posted online constitutes the effective date.

Article 1 : Contract

The customer declares to be 18 years old and have the legal capacity to contract on the Site or to hold parental authorization allowing him to place an order.

The customer also declares to have read and agrees to comply with these General Conditions.

To place an order, the Internet user has the option of first creating an account on the Site by providing information including their name, postal address, telephone number and email address, or of providing all of this information when confirming their order.

The customer is solely responsible for entering their information, LES DETECTEURS cannot be held responsible for any error concerning the Internet user’s personal information.

Automatic registration is considered as proof of the nature and content of the order. LES DETECTEURS confirms acceptance of the order to the customer at the email address provided by the customer. The sale will be concluded upon validation by LES DETECTEURS of payment for the order, i.e. the date of validation of the payment for orders paid online by the means of payment made available or the date of receipt of payment by other possible means. LES DETECTEURS reserves the right to check and/or refuse an order if there is a prior dispute in progress or an abnormally high level of orders.

Article 2 : Les products

LES DETECTEURS strives to describe and present the products sold on the Site with the greatest accuracy. However, certain characteristics of the products may be slightly modified, in particular to adapt to improvements made by our suppliers.

LES DETECTEURS cannot be held responsible for any error of judgment related to the use of the Internet network. As long as our offers and their prices are visible on the site, they are valid. The availability indicated at the time of consultation of the site by the customer remains dependent on the state of the stock at LES DETECTEURS and of course at the suppliers.

Our sales catalog is continually updated and enriched based on information provided by our suppliers. Our catalog contains hundreds of items, some of which are not stored in our warehouses, which means that our offer is then subject to the availability of items from suppliers.

Only the definitive rupture of an item at our suppliers results in its deletion from our catalog. In other cases, a new order within a certain period remains possible.

When there is unavailability of an ordered product, the customer is informed by email or on the invoice for the products shipped in the case of an order for several items.

Article 3 : Prices

The prices displayed on the Site are indicated in euros and include all taxes applicable in Metropolitan France (including Corsica) excluding DOM-TOM. VAT is applied at the rate in effect at the time of the order. Any change in rate would be immediately reflected on the Site, but the rate applicable to your order will be the one in effect at the time of validation of the order.

For all orders that will be intended for and delivered in the European Union, the prices of the products are exclusive of shipping costs, excluding the price of certain packaging or excluding the price of other optional services, subscribed to by the Internet user, which remain in addition. Article 4 : Shipping costs

Shipping costs are free for all orders with a value greater than €150 AND which are destined for a country in the European Union. Otherwise, a flat rate amount depending on the destination of the order will be applied.

LES DETECTEURS reserves the right to offer free, and exceptionally, shipping costs for a customer, for a group of customers or for all customers.

Article 5 : Payment

You have several payment methods offering maximum security guarantees. You can pay:

– By Stripe Payment: You have different payment methods and you can even benefit from payment facilities by bank card.

– By bank transfer

Payment is made on the secure banking servers of our partners. This means that no banking information about you is transmitted via the LES DETECTEURS website.

Payment by bank card is therefore perfectly secure; your order will be recorded and validated as soon as the payment is accepted by the bank.

For payment by bank transfer, your order will remain pending until receipt of proof of payment (to be sent to the email address: paiement@les-detecteurs.fr) for orders under €500 and until receipt of funds for orders over €500.

Article 6 : Terms of delivery and collection of orders

All orders are generally shipped from our warehouse located in France. However, for some products, shipping is handled directly by one of our partners.

The ordered products are shipped upon final validation of the order by our sales team. They are delivered to the address provided by the buyer on the order form, and it is their sole responsibility to ensure its accuracy. In the event of a package being returned to the seller due to an incorrect or incomplete delivery address, the reshipping costs will be borne by the buyer.

The buyer has the option to request that an invoice be issued to the billing address rather than the delivery address, by selecting the appropriate option on the order form. If the buyer is absent at the time of delivery, the delivery person will leave a notice in the mailbox, allowing the package to be collected at the location and within the time indicated.

If, at the time of delivery, the original packaging is damaged, torn or open, the buyer must check the condition of the items. In the event of damage, it is imperative to refuse the package and note a reservation on the delivery slip (package refused due to opening or damage). The buyer must also report any anomaly on the delivery slip in the form of handwritten reservations, accompanied by his signature (damage, missing product, damaged package, broken products, etc.).

This verification is considered to have been carried out as soon as the buyer, or a person authorized by him, has signed the delivery note. The buyer must then confirm these reservations to the carrier by registered mail within two working days following receipt of the items, and send a copy of this letter by simple mail to the seller at the address indicated in the legal notices of the site.

If the products are to be returned to the seller, a return request must be made within 14 days of delivery. Any claim made after this period will not be accepted. The return of products will only be accepted if they are in their original condition (packaging, accessories, instructions, etc.).

Delivery errors:

The customer agrees to check the conformity of the product to his order upon delivery. Any delivery error in relation to the order or apparent defect must be the subject of a complaint by mail or email (reclamation@les-detecteurs.fr) from the day of delivery.

The customer has a period of 24 hours after delivery to report a lack of conformity of the order.
After this period, the product will be deemed to have been received in conformity by the customer, who will no longer be able to claim a delivery error or an apparent defect.

Article 7 : Transfer of ownership

The transfer of ownership of the products to the benefit of the purchaser will only be carried out after full payment of the price by the latter, regardless of the date of delivery of said products. On the other hand, the transfer of the risks of loss and deterioration of the products will only be carried out upon delivery and receipt of said products by the purchaser.

Article 8 : Responsibilities

The descriptions of the products present in the databases of this Site have been entered according to the information communicated by the publishers. LES DETECTEURS is not responsible for the content of the works and cannot be held liable to the purchaser. LES DETECTEURS cannot be held liable in the event of force majeure (strike, flood, fire, etc.).

LES DETECTEURS declines all responsibility if the delivered item does not comply with the legislation of the country of delivery (censorship, prohibition, etc.). Article 9 : Cancellation, Return and Refund

In accordance with article L121-21 of the Consumer Code, the Customer has a period of fourteen working days from the date of receipt of their order to exercise their right of withdrawal and thus return the product to the seller for exchange or refund without penalty.

Once your request has been validated by LES DETECTEURS, you must return or hand over the goods to 84 Avenue FRANKLIN ROOSEVELT 06110 Le Cannet – France without undue delay and in any event no later than fourteen days after you have communicated to us your decision to withdraw from this contract. This deadline is deemed to have been met if you return the goods before the expiry of the fourteen-day period.

Returns must be made in their original condition and complete (packaging, accessories, instructions, etc.) allowing them to be resold as new, accompanied by the purchase invoice.

Damaged, soiled or incomplete products will not be accepted. Products must be returned in their original packaging, without having been opened or used.

Return costs are the responsibility of the Customer.

The exchange (subject to availability) or refund will be made within 14 days, and at the latest, within 14 days from receipt by the seller of the products returned by the buyer under the conditions provided above.

Exception to the right of withdrawal

The exercise of the right of withdrawal is excluded for the following contracts:

– supply of goods whose price depends on fluctuations in the financial market beyond the control of the professional and likely to occur during the withdrawal period;

– supply of goods made to the consumer’s specifications or clearly personalized;

– supply of goods liable to deteriorate or expire rapidly;

– the supply of goods which have been unsealed by the consumer after delivery and which cannot be returned for reasons of hygiene or health protection;

– the supply of goods which, after being delivered and by their nature, are inseparably mixed with other items;

No request for withdrawal or return will be possible for orders delivered outside the European Union.

Article 10 : Guarantees

Legal guarantee of conformity and legal guarantee of hidden defects 

LES DETECTEURS guarantees the conformity of the goods to the contract, allowing the buyer to make a request under the legal guarantee of conformity provided for in Articles L. 217-4 et seq. of the Consumer Code or the guarantee of defects in the thing sold within the meaning of Articles 1641 et seq. of the Civil Code. 

In the event of implementation of the legal guarantee of conformity, it is recalled that:

  • The customer has a period of 2 years from delivery of the goods to take action
  • The customer can choose between repair or replacement of the goods, subject to the cost conditions provided for in Article L. 217-17 of the Consumer Code.
  • The customer does not have to provide proof of the non-conformity of the goods during the 24 months in the case of new goods, following delivery of the goods.

Furthermore, it is recalled that:

  • The legal guarantee of conformity applies independently of the commercial guarantee indicated below.
  • The customer may decide to implement the guarantee against hidden defects of the thing sold within the meaning of article 1641 of the civil code. In this case, he can choose between the resolution of the sale or a reduction in the price in accordance with article 1644 of the civil code.

The warranty entitles you to free labor and free replacement of defective parts, with any transportation of the device always being the buyer’s responsibility.   • Transport carried out without precautions
  • Batteries leaking into the device
  • An external agent impact (fire, lightning, flood, excessive humidity, etc.)
  • Wear and shock of equipment
  • Intervention on the electronic part

Applications: The benefit of the guarantee is acquired under the following conditions:

  • The repair must be carried out in our establishments or at our partners
  • The device number and warranty label must not be removed or modified.
  • Any warranty seals must not be broken or removed.

Article 11 : Applicable law

All clauses appearing in these general conditions of sale, as well as all purchase and sale operations referred to therein, will be subject to French law.

Article 12 : Acceptance by the purchaser

These general terms and conditions of sale and the prices are expressly approved and accepted by the purchaser, who declares and acknowledges having perfect knowledge of them, and therefore waives the right to rely on any contradictory document and, in particular, his own general terms and conditions of purchase, the act of purchase entailing acceptance of these general terms and conditions.
